These Terms of Use (the "Terms") are an agreement between you and Exerevno Limited, a company registered in New Zealand ("Exerevno", "we", "us", or "our"), governing your use of Sartia, our personal color analysis app for iOS and Android (the "App" or the "Service").
By downloading, installing, or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
You must be 16 years or older to use Sartia. The Service is not directed to children under 16. You confirm your age when you accept the analysis consent screen. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian who agrees to these Terms.
Sartia analyses a photo of your face using an AI vision model and returns a personal color season, a confidence level, and a palette of colors that suit you along with the shades to ease off. A paid Style+ subscription adds facial structure analysis, style guidance, an outfit checker, and wardrobe matching.
Sartia is style guidance, not advice of any professional kind. Results are produced by an AI model from a single photo and are inherently subjective and approximate. Lighting, camera, makeup, and image quality all affect the outcome. Sartia is not medical, dermatological, psychological, or professional advice, and you should not rely on it as such. Use your own judgement before making purchases based on your result.
Sartia is for analysing your own appearance. When you use the App you agree that:
How your photo is handled, including the fact that it is deleted within 24 hours by default and never used to train AI models, is set out in our Privacy Policy.
You create a Sartia account when you complete a purchase. You are responsible for keeping access to your account and to the email address and password you use with it. Tell us promptly at hyon.shim@exerevno.co.nz if you believe your account has been used without your authorisation.
You may delete your account at any time from within the App. See our account deletion page for the steps and for what happens to your data.
Sartia offers a Style+ subscription (weekly, monthly, or annual) and a one-time Full Color Report purchase. Prices are shown in the App before you buy, in your local currency where the store supports it.
We may change prices or the contents of a plan. A price change to an existing subscription takes effect only from the next billing period and only after the store notifies you as its rules require.
The App includes a free analysis allowance before the paywall, and the analysis endpoints are rate limited to protect the Service against abuse and runaway cost. We may adjust these limits, and we may suspend access where we detect abuse, automated use, or attempts to bypass entitlement checks.
The App, the Sartia name and brand, the interface, the analysis pipeline, and all associated content are owned by Exerevno Limited or its licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial purposes, subject to these Terms.
Your content. You keep all rights in the photo you upload. You grant us only the limited licence necessary to process that photo to produce your result and to operate the Service, for the retention period described in the Privacy Policy. We do not use your photo to train AI models, and we do not use it for marketing.
Your result. You may use your own season, palette, and guidance freely for personal purposes, including sharing it.
We aim to keep Sartia available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service, and we may release updates that change features. Where a change materially reduces a paid feature you are currently entitled to, we will tell you in the App.
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that any color season, palette, or style guidance is correct, complete, or suitable for you.
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot lawfully be excluded, including under the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986, or the Australian Consumer Law. Where you acquire the Service for business purposes, the Consumer Guarantees Act does not apply.
To the maximum extent permitted by law, Exerevno Limited is not liable for any indirect, incidental, special, consequential, or exemplary loss, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability arising out of or in connection with the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or NZ$100.
You agree to indemnify Exerevno Limited against any claim, loss, or cost arising from your breach of these Terms, your misuse of the Service, or your upload of a photo of another person without that person's consent.
You may stop using the App at any time and delete your account from within it. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if continuing to provide the Service to you would expose us or other users to risk. Sections that by their nature should survive termination (including Sections 8, 10, 11, 12, and 15) survive it.
Your use of the App is also subject to the terms of the store you downloaded it from. These Terms are between you and Exerevno Limited only. Apple and Google are not parties to them and are not responsible for the App, though Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you as an iOS user.
These Terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer laws of your country of residence.
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and, where changes are material, take reasonable steps to notify you in the App. Continuing to use the App after a change takes effect means you accept the revised Terms.
