By downloading, installing, opening, accessing, browsing, or otherwise using Day Old, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms in their entirety, you must not download, install, access, or use Day Old.
"Day Old" or the "Service" means, collectively:
These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Exerevno Limited ("we", "us", or "our"), an entity established in New Zealand with its principal place of business at Level 4, 125 Queen St, Auckland 1010, New Zealand. Day Old is published under Exer-labs, a studio of Exerevno Limited; Exerevno Limited is the contracting party under these Terms. If you are using Day Old on behalf of an organisation, you represent that you have authority to bind that organisation. Where a section applies only to one surface, it is clearly labelled (Mobile App) or (Web App).
Day Old is a daily news recap covering artificial intelligence and technology. The Service:

It does not require account registration, does not collect personal information from Users, and does not facilitate user-generated content or social interaction. Future versions may introduce optional account functionality; any such changes will be reflected in updated Terms and Privacy Policy prior to release.
The Web App is a static website requiring no download or installation; access is via any modern browser at www.exer-labs.app/day_old/. It is served from Netlify's CDN. These Terms apply to the Web App in the same way as the Mobile App except where a provision is expressly limited to one surface.
Day Old is intended for persons aged 13 years or older. By using Day Old, you represent that you are at least 13. If you are under 18 (or the age of legal majority in your jurisdiction), you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly direct Day Old at children under 13; if you believe a child under 13 has used Day Old, contact us at info@exerevno.co.nz.
Day Old, including the Mobile App and Web App software, code, design, interface, graphics, layout, and underlying technology (excluding third-party content and AI-generated Recap content), is owned by or licensed to Exerevno Limited and protected by copyright, trade-mark, and other intellectual-property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use Day Old solely for your personal, non-commercial purposes in accordance with these Terms.
The daily Recap is generated by an automated AI pipeline operated by or on behalf of Exerevno Limited. To the extent intellectual-property rights subsist in the Recap content, those rights vest in Exerevno Limited as the operator of the pipeline. You may read and share individual Recap summaries for personal, non-commercial purposes. Systematic reproduction, scraping, redistribution, or commercial exploitation of Recap content is prohibited without our prior written consent.
Individual articles referenced within Day Old are the intellectual property of their respective publishers and are sourced from publicly available feeds. Exerevno Limited does not claim ownership of third-party article content. When you open an article (in the in-app browser on the Mobile App or a new tab on the Web App), you access it directly on the publisher's website and are subject to that publisher's terms and policies.
If you provide suggestions, ideas, or feedback about Day Old ("Feedback"), you grant Exerevno Limited a perpetual, irrevocable, royalty-free, worldwide licence to use, reproduce, modify, and incorporate such Feedback into Day Old or other products without obligation to you.
You acknowledge and agree that:
(a) the Recap is generated by an automated artificial-intelligence language model and is not written, reviewed, or verified by a journalist, editor, or human fact-checker prior to publication;
(b) the Recap may contain inaccuracies, omissions, errors, outdated information, mischaracterisations, fabrications ("hallucinations"), or opinions that do not reflect the views of Exerevno Limited;
(c) the Recap is provided for general informational purposes only and does not constitute professional advice of any kind, including financial, legal, medical, tax, or investment advice;
(d) you should independently verify any information in the Recap before relying upon it; and
(e) Exerevno Limited expressly disclaims all responsibility for any decisions made, actions taken, or losses incurred in reliance on the Recap.
The Mobile App displays an "AI-generated summary" label on each Recap to make this clear. If you believe a Recap contains an error or other issue, you can report it to us at info@exerevno.co.nz (the Mobile App provides a "Report an issue with this recap" action that prefills this email with the Recap date). News events change rapidly; content within Day Old may become outdated at any time, and Exerevno Limited is under no obligation to update previously published Recaps.
When you tap a source article or citation in the Mobile App, it opens in an integrated WebView browser. Exerevno Limited has no control over, and accepts no responsibility for, the content, privacy practices, terms, advertising, security, or conduct of any third-party website accessed through the in-app browser.
When you click a source article on the Web App, it opens in a new tab in your system browser. Once opened, that tab is governed entirely by your own browser and the publisher's website. Exerevno Limited has no control over, and accepts no responsibility for, that third-party content.
The inclusion of a source article or publisher within Day Old does not constitute an endorsement, recommendation, sponsorship, or affiliation.
Your use of any third-party website accessed through Day Old is governed solely by that website's terms and privacy policy. We encourage you to review them.
The Mobile App may direct you to the App Store or Google Play. Those platforms are operated by Apple Inc. and Google LLC respectively, and your use of them is subject to their own terms.
The Web App does not set cookies. Day Old stores a small amount of data locally on your device or browser — your theme preference, reminder setting, saved Recaps, and an anonymous analytics identifier (on the Web App, a dark theme key in localStorage and a tab-scoped session ID in sessionStorage). None of these are cookies or contain personal information. Both the Mobile App and the Web App collect first-party, anonymous usage analytics (page/screen views, navigation, content engagement) written to Exerevno Limited's own database; no third-party analytics tool is used and no personal data is collected. On the Mobile App you can turn analytics off at any time via the "Share anonymous usage stats" toggle in Settings. Full detail, including the legal basis, is in our Privacy Policy.
You agree that you will not:
(a) use Day Old for any unlawful purpose or in violation of any applicable law;
(b) attempt to gain unauthorised access to Day Old, its backend, hosting infrastructure, or any related network or server;
(c) reverse engineer, decompile, disassemble, or attempt to derive the source code of the Mobile App or the Web App's JavaScript bundle except as expressly permitted by law;
(d) remove, alter, obscure, or circumvent any copyright, trade-mark, technical protection measure, or other proprietary notice;
(e) use automated scripts, bots, scrapers, or crawlers to access, query, monitor, or extract data from Day Old, its backend database, or any page of the Web App;
(f) reproduce, redistribute, sublicense, sell, or commercially exploit any portion of Day Old or its content without prior written authorisation;
(g) use Day Old or any portion of its content — including Recap text, headlines, summaries, structured metadata, or assembled content collections — to train, fine-tune, validate, benchmark, or evaluate any artificial-intelligence model (including large language models, generative models, or machine-learning systems), or to assemble, augment, or distribute any dataset for such purposes, without our prior express written consent. The robots.txt and HTTP headers served by the Web App, together with these Terms, constitute an express reservation of rights under Article 4(3) of EU Directive 2019/790 on copyright in the Digital Single Market, the UK text-and-data-mining exception under section 29A of the Copyright, Designs and Patents Act 1988, and any equivalent provision in other jurisdictions;
(h) interfere with or disrupt the integrity or performance of Day Old or its servers, or probe, scan, or test the vulnerability of any system used to provide Day Old;
(i) frame, mirror, or embed Day Old or its content within another website or application without our prior written consent; or
(j) export or re-export Day Old in violation of the export-control or sanctions laws of any applicable jurisdiction.
Day Old is provided on an "as available" basis. We do not guarantee uninterrupted availability. There may be days on which no Recap is published due to technical issues, maintenance, or data availability. Web App availability also depends on third-party services including Netlify and Supabase.
We reserve the right to modify, suspend, or discontinue Day Old (or any feature, including either surface individually) at any time, with or without notice, and without liability to you.
We may update Day Old from time to time. Continued use after an update constitutes acceptance of any changes to its functionality.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAY OLD AND ALL CONTENT DELIVERED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. EXEREVNO LIMITED SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
Some jurisdictions do not allow the exclusion of implied warranties; the above exclusion may not apply to you in full. If you are a "consumer" within the meaning of the New Zealand Consumer Guarantees Act 1993 acquiring Day Old for personal, domestic, or household use, the guarantees under that Act may apply and are not limited or excluded by these Terms. Where Day Old is acquired for business purposes, the parties agree that the Consumer Guarantees Act 1993 does not apply pursuant to section 43 of that Act.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXEREVNO LIMITED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE DAY OLD, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID (IF ANY) FOR DAY OLD IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED NEW ZEALAND DOLLARS (NZD $100.00).
Nothing in these Terms excludes or limits liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; (iii) any liability under Part 2 of the Consumer Guarantees Act 1993 (NZ) where it applies and cannot be contracted out of; (iv) for UK users, any liability under the Consumer Rights Act 2015 that cannot be excluded; or (v) any other liability that cannot be excluded or limited by applicable law.
You agree to indemnify, defend, and hold harmless Exerevno Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of Day Old in violation of these Terms; (b) your violation of any applicable law or third-party right; or (c) any content or material you transmit through or in connection with Day Old.
This Section applies only to the Mobile App.
13.1 Acknowledgement. These Terms are between you and Exerevno Limited only, not Apple Inc. ("Apple") or Google LLC ("Google"). Exerevno Limited, not Apple or Google, is solely responsible for the Mobile App and its content.
13.2 Scope of Licence (Apple). The licence is limited to a non-transferable licence to use the Mobile App on any Apple-branded products you own or control, as permitted by the Apple Media Services Terms of Service.
13.3 Maintenance and Support. Apple and Google have no obligation to provide maintenance or support; any such support is Exerevno Limited's responsibility to the extent required by law.
13.4 Warranty. In the event of any failure of the Mobile App to conform to any applicable warranty, you may notify Apple or Google, who will refund the purchase price (if any). To the maximum extent permitted by law, Apple and Google have no other warranty obligation.
13.5 Product Claims. Exerevno Limited, not Apple or Google, is responsible for addressing any claims relating to the Mobile App, including product-liability, regulatory-conformity, and consumer-protection or privacy claims.
13.6 Intellectual Property Infringement. In the event of a third-party claim that the Mobile App infringes intellectual-property rights, Exerevno Limited, not Apple or Google, is solely responsible for its investigation, defence, settlement, and discharge.
13.7 Third-Party Beneficiary (Apple). Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your use of the Mobile App distributed through the App Store and may enforce these Terms against you.
13.8 Google Play. The licence for the Mobile App distributed through Google Play is subject to Google Play's Terms of Service; Exerevno Limited bears all maintenance, support, warranty, and product-claim responsibilities.
13.9 Account Creation and Deletion. The Mobile App does not require or offer account creation. If a future version introduces account functionality, we will provide an account-deletion mechanism compliant with both the App Store and Google Play.
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date and, where changes are material, notify you through the app, on the Web App, or by other appropriate means. Continued use after a change constitutes acceptance of the revised Terms.
These Terms are governed by the laws of New Zealand, without regard to conflict-of-law provisions. Any dispute that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Auckland, New Zealand. Nothing in this Section affects your rights as a consumer to bring proceedings in the country in which you are habitually resident where you are entitled to do so under mandatory consumer-protection law. EU consumers may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
If any provision of these Terms is held invalid, illegal, or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or if not possible, severed, and the remaining provisions continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Exerevno Limited with respect to Day Old and supersede all prior agreements relating to its subject matter.
