By downloading, installing, opening, accessing, browsing, or otherwise using Bites, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms in their entirety, you must not download, install, access, or use Bites.
"Bites" or the "Service" means, collectively:
These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Exerevno Limited ("we", "us", or "our"), an entity established in New Zealand with its principal place of business at Level 4, 125 Queen St, Auckland 1010, New Zealand.
If you are using Bites on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms, and references to "you" include that organisation.
Where a section applies only to one surface, it is clearly labelled (Mobile App) or (Web App).
Bites is a daily news digest covering artificial intelligence and technology. The Service:
target="_blank" rel="noopener"), so that you read them in your own browser environment rather than within the Web App; andBites is a passive content-delivery tool. It does not require account registration, does not collect personal information from Users, and does not facilitate user-generated content or social interaction. Future versions may introduce optional account functionality; any such changes will be reflected in updated Terms and Privacy Policy prior to release.
The Web App is a static website. No download or installation is required; access is via any modern web browser at exer-labs.app/bites/. The Web App is served from Netlify's content delivery network. These Terms apply to your use of the Web App in the same way as they apply to the Mobile App, except where a provision is expressly limited to one surface.
Bites is intended for use by persons aged 13 years or older. By using Bites, you represent that you are at least 13 years of age. If you are under the age of 18 (or the age of legal majority in your jurisdiction), you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We do not knowingly direct Bites at children under the age of 13. If you are a parent or guardian and believe your child under the age of 13 has used Bites, please contact us at info@exerevno.co.nz.
Bites, including the Mobile App and Web App software, code, design, interface, graphics, layout, and underlying technology (excluding third-party content and AI-generated Digest content), is owned by or licensed to Exerevno Limited and is protected by copyright, trade mark, and other applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use Bites solely for your personal, non-commercial purposes in accordance with these Terms.
The daily Digest is generated by an automated AI pipeline operated by or on behalf of Exerevno Limited. To the extent that intellectual property rights subsist in the Digest content, those rights vest in Exerevno Limited as the operator of the pipeline. You may read and share individual Digest summaries for personal, non-commercial purposes. Systematic reproduction, scraping, redistribution, or commercial exploitation of Digest content is prohibited without our prior written consent.
Individual articles referenced within Bites are the intellectual property of their respective publishers and are sourced from publicly available feeds. Exerevno Limited does not claim ownership of third-party article content. When you open an article (in the in-app browser on Mobile App or in a new tab on Web App), you access it directly on the publisher's website and are subject to that publisher's terms of use and intellectual property policies.
If you provide suggestions, ideas, or feedback about Bites ("Feedback"), you grant Exerevno Limited a perpetual, irrevocable, royalty-free, worldwide licence to use, reproduce, modify, and incorporate such Feedback into Bites or other products without obligation to you.
You acknowledge and agree that:
(a) The Digest is generated by an automated artificial intelligence language model and is not written, reviewed, or verified by a journalist, editor, or human fact-checker prior to publication;
(b) The Digest may contain inaccuracies, omissions, errors, outdated information, mischaracterisations, fabrications ("hallucinations"), or opinions that do not reflect the views of Exerevno Limited;
(c) The Digest is provided for general informational purposes only and does not constitute professional advice of any kind, including but not limited to financial, legal, medical, tax, or investment advice;
(d) You should independently verify any information contained in the Digest before relying upon it for any purpose; and
(e) Exerevno Limited expressly disclaims all responsibility for any decisions made, actions taken, or losses incurred in reliance on the Digest.
News events and the information related to them change rapidly. Content within Bites may become outdated at any time and Exerevno Limited is under no obligation to update previously published Digests.
When you tap on a source article in the Mobile App, the Mobile App opens that article in an integrated WebView browser. Exerevno Limited has no control over, and accepts no responsibility for, the content, privacy practices, terms of use, advertising, security, or conduct of any third-party website accessed through the in-app browser.
When you click a source article on the Web App, the article opens in a new tab in your system browser (using target="_blank" rel="noopener"). Once opened, the new tab is governed entirely by your own browser environment and the publisher's website. Exerevno Limited has no control over, and accepts no responsibility for, the content, privacy practices, terms of use, advertising, security, or conduct of any third-party website opened from the Web App.
The inclusion of a source article or publisher within Bites does not constitute an endorsement, recommendation, sponsorship, or affiliation between Exerevno Limited and that publisher or its content.
Your use of any third-party website accessed through Bites (whether via the in-app browser or by opening a new tab) is governed solely by the terms and privacy policies of that website. We encourage you to review those policies before engaging with third-party content.
The Mobile App may direct you to the Apple App Store or Google Play Store. Those platforms are operated by Apple Inc. and Google LLC respectively, and your use of those platforms is subject to their own terms and conditions.
The Web App does not set cookies. The Web App uses two browser storage keys: bites-dark (in localStorage) to remember your chosen light/dark display theme across visits, and bites-sid (in sessionStorage) — a random UUID that groups first-party analytics events within a single browser tab session and is automatically deleted when the tab is closed. Neither key is a cookie or contains personal information. The Web App collects first-party usage analytics (page views, navigation events, content engagement) using this tab-scoped session identifier and writes them to Exerevno Limited's own database; no third-party analytics tool is used and no personal data is collected. Full detail, including the legal basis for this processing, is set out in our Privacy Policy.
You agree that you will not:
(a) Use Bites for any unlawful purpose or in violation of any applicable law or regulation;
(b) Attempt to gain unauthorised access to Bites, its backend systems, hosting infrastructure, or any related network or server;
(c) Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Mobile App or the Web App's JavaScript bundle except to the extent expressly permitted by applicable law;
(d) Remove, alter, obscure, or circumvent any copyright, trade mark, technical protection measure, or other proprietary notice within Bites;
(e) Use automated scripts, bots, scrapers, crawlers, or other automated means to access, query, monitor, or extract data from Bites, its backend database, or any page of the Web App;
(f) Reproduce, redistribute, sublicense, sell, or commercially exploit any portion of Bites or its content without prior written authorisation;
(g) Use Bites or any portion of its content — including Digest text, headlines, summaries, structured metadata, or assembled content collections — to train, fine-tune, validate, benchmark, or evaluate any artificial intelligence model (including large language models, generative models, or machine learning systems), or to assemble, augment, or distribute any dataset for such purposes, without our prior express written consent. The robots.txt and HTTP headers served by the Web App, together with these Terms, constitute an express reservation of rights under Article 4(3) of the EU Directive 2019/790 on copyright in the Digital Single Market, the UK text and data mining exception under section 29A of the Copyright, Designs and Patents Act 1988, and any equivalent provision in other jurisdictions;
(h) Interfere with or disrupt the integrity or performance of Bites or its servers, or attempt to probe, scan, or test the vulnerability of any system used to provide Bites;
(i) Frame, mirror, or embed Bites or its content within another website or application without our prior written consent; or
(j) Export or re-export Bites in violation of the export control or sanctions laws and regulations of any applicable jurisdiction.
Bites is provided on an "as available" basis. We do not guarantee that Bites will be available at all times or without interruption. There may be days on which no Digest is published due to technical issues, maintenance, or data availability. Availability of the Web App also depends on the availability of third-party services including Netlify, Supabase, and Google Fonts.
We reserve the right to modify, suspend, or discontinue Bites (or any feature thereof, including either the Mobile App or the Web App individually) at any time, with or without notice, and without liability to you.
We may update Bites from time to time. Continued use of the Mobile App or the Web App after an update constitutes your acceptance of any changes to its functionality.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BITES AND ALL CONTENT DELIVERED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. EXEREVNO LIMITED SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
Some jurisdictions do not allow the exclusion of implied warranties; the above exclusion may not apply to you in full. If you are a "consumer" within the meaning of the New Zealand Consumer Guarantees Act 1993, and you are acquiring Bites for personal, domestic, or household use, the guarantees under that Act may apply and are not limited or excluded by these Terms. Where Bites is acquired for the purposes of a business, the parties agree that the Consumer Guarantees Act 1993 does not apply pursuant to section 43 of that Act.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXEREVNO LIMITED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE BITES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID (IF ANY) FOR BITES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED NEW ZEALAND DOLLARS (NZD $100.00).
Nothing in these Terms excludes or limits liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; (iii) any liability under Part 2 of the Consumer Guarantees Act 1993 (NZ) where it applies and cannot be contracted out of; (iv) for users in the United Kingdom, any liability under the Consumer Rights Act 2015 that cannot be excluded; or (v) any other liability that cannot be excluded or limited by applicable law.
You agree to indemnify, defend, and hold harmless Exerevno Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of Bites in violation of these Terms; (b) your violation of any applicable law or third-party right; or (c) any content or material you transmit through or in connection with Bites.
This Section 13 applies only to the Mobile App distributed via the Apple App Store and Google Play, and does not apply to the Web App.
You acknowledge that these Terms are between you and Exerevno Limited only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Exerevno Limited, not Apple or Google, is solely responsible for the Mobile App and its content.
The licence granted to you for the Mobile App is limited to a non-transferable licence to use the Mobile App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms of Service ("Usage Rules").
Apple and Google have no obligation to provide maintenance or support services in respect of the Mobile App. Any such support is Exerevno Limited's responsibility to the extent required by applicable law.
In the event of any failure of the Mobile App to conform to any applicable warranty, you may notify Apple or Google, and Apple or Google will refund the purchase price of the Mobile App (if any) to you. To the maximum extent permitted by law, Apple and Google have no other warranty obligation in respect of the Mobile App.
Exerevno Limited, not Apple or Google, is responsible for addressing any claims you or any third party may have relating to the Mobile App, including: (a) product liability claims; (b) claims that the Mobile App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the Mobile App or your possession and use of it infringes that third party's intellectual property rights, Exerevno Limited, not Apple or Google, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your use of the Mobile App distributed through the Apple App Store, and that upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary thereof.
The licence granted to you for the Mobile App distributed through Google Play is subject to Google Play's Terms of Service. Exerevno Limited bears all responsibilities for maintenance, support, warranty, and product claims in respect of the Mobile App.
The Mobile App does not require or offer account creation. If a future version introduces account functionality, we will provide a mechanism for account deletion in compliance with the requirements of both the Apple App Store and Google Play.
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this document and, where the changes are material, notify you through the Mobile App, on the Web App, or by other appropriate means. Your continued use of Bites after any change to these Terms constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms or Bites that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Auckland, New Zealand.
Nothing in this Section affects your rights as a consumer to bring proceedings before the courts of the country in which you are habitually resident where you are entitled to do so under mandatory consumer protection law.
If you are a consumer located in the European Union, you may also have access to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms, and the remaining provisions will continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Exerevno Limited with respect to Bites and supersede all prior agreements, representations, and understandings relating to the subject matter hereof.
